A Gondia court awarded life prisonment till natural death to a 25-year old
man for raping his 53-year-old mother in an inebriated state in 2021.
Sessions judge SAAR Auti also ordered labourer accused to pay Rs1 lakh to his
mother within six months. The District Legal Services Authority (DLSA) was also directed
to pay compensation to the survivor, who is also a labourer.
The Gondia woman was living alone with her two sons, including the accused, after her
husband, a habitual drunkard, deserted them seven years ago.
Even the accused used to do nothing and drink regularly on his mother’s earnings.
The incident took place on August 21, 2021, when the woman returned home after day’s
work and went to take a bath. When she came out, Bisen was intoxicated and demanded
money for liquor. When she declined, he called her to his room and forced himself on her.
Despite her pleadings that she was his mother, he refused to listen. He also threatened
her with dire consequences if she revealed anything to anyone.
After his heinous act, the survivor decided to end her life by jumping into the well, but
couldn’t gather the courage. She then went to her brother’s home, who stays in the
neighbourhood. As he was not at home, the victim narrated her ordeal to his wife and
children, who advised her to immediately approach the police.
After her complaint at Rawanwadi police station the same day, she was taken to Gangabai
Women’s Hospital at Gondia for a medical test, where she informed the medical officer
about injuries sustained in the assault by the son.
Next day, the cops booked the accused under Sections 376(2)(f)(m), 323 and 506 of IPC
for rape and assault on the victim and arrested him.
During trial, additional public prosecutor Satish Ghode strongly pressed for sending the
accused to gallows, contending that his act is a blot on humanity and the case comes
under the definition of ‘rarest of rare’.
In view of the gravity of the offence, the judge also expedited the hearing, and completed
the trial in two months and three days. The case was received and registered on October
29, while the judgement was pronounced on February 1.
While convicting him of the rape and other offences under all three sections of IPC, judge
Auti specifically mentioned that Bisen’s lifer would mean imprisonment for the remainder
of his natural life, and also imposed a fine of Rs2,000. Under Sections 323 and 506, he
was sentenced to one year each behind bars along with a fine of Rs500 each.
The court made it clear that all substantive sentences would run concurrently as per
Section 31 of the Criminal Procedure Code (CrPC).
